The Courts attitude on Arbitration
The court recognizes the arbitration process to be a quick, economical,
and practical solution to commercial problems that are inherent to the
workings of international commerce. Arbitrationin general, and maritime
arbitration specifically is viewed by the courts as an avenue of reducing
the heavy case loads before them. Judges view the United States Arbitration
Act as an indication that the U S Congress intended to encourage
arbitration. If there is any doubt as to the right to arbitrate, the courts
will generally enforce that right.
